Terms of Service
These terms explain what you get when you pay for CueSwitch, what we expect from venue owners and DJs, and what happens when something goes wrong.
The short version
- CueSwitch is a hosted radio stream and club toolkit for Second Life venues, run by Split Desire (Second Life avatar solokkhz Monstre). It is not part of Linden Lab.
- You pay in L$ at an in-world CueSwitch Terminal. A club venue costs L$400 for 1 week, L$1,600 for 4 weeks or L$4,800 for 12 weeks. A personal DJ Live or DJ Radio stream is sold at the Performer Terminal in the CueSwitch store: DJ Live L$75 for 1 week, L$300 for 4 weeks or L$900 for 12 weeks, DJ Radio L$150 for 1 week, L$600 for 4 weeks or L$1,800 for 12 weeks. You pay in advance. Unless you switch on autopay on your Home Terminal (clubs only), nothing renews by itself.
- When your paid time runs out you get 3 days of grace, then the stream pauses. 30 days after the pause, the venue and its music are deleted. A DJ Live or DJ Radio stream is deleted 7 days after the pause.
- You are responsible for having the rights to everything you upload or stream. We remove infringing content and close the venues of repeat infringers.
- Tips go into the venue owner’s jar. Our script splits them with the DJ on deck. CueSwitch never holds tip money.
- We run the service on a best-effort basis with no uptime guarantee, and our liability is limited to what you recently paid us.
This summary is here to help. The numbered sections below are the full text.
1. Who we are and who these terms cover #
CueSwitch (“CueSwitch”, “we”, “us”) is operated by Split Desire (Second Life avatar solokkhz Monstre). You can reach us at [email protected].
These terms apply to everyone who uses CueSwitch:
- venue owners, who pay for a venue at a CueSwitch Terminal;
- DJs, who stream through a venue’s station;
- performers (DJs, singers and event hosts), who buy a personal DJ Live or DJ Radio stream for themselves;
- everyone else who uses a CueSwitch board, tip jar or terminal in Second Life, such as listeners, tippers and alert subscribers.
The Privacy Policy and the Refund Policy are part of these terms. Where a section only applies to owners, to DJs or to DJ Live and DJ Radio, it says so.
2. Accepting these terms #
You accept these terms when you pay at a CueSwitch Terminal, open a CueSwitch dashboard link, or use a CueSwitch board or tip jar. Every terminal shows this line:
Paying means you accept the Cueswitch terms: cueswitch.com/legal/terms
If you don’t agree, don’t pay and don’t use the service.
You must be allowed to use Second Life under Linden Lab’s terms, and old enough where you live to make this agreement. The avatar whose payment starts a venue is its owner, and the owner is the avatar we deal with about the venue. A club owner may add managers who use the club’s dashboard and may renew it, and may hand the club to one of them, who then becomes its owner.
3. Second Life and Linden Lab #
CueSwitch is an independent service. It is not made, endorsed or supported by Linden Lab. Second Life is a trademark of Linden Research, Inc.
Using CueSwitch does not replace Linden Lab’s rules. You must also follow the Second Life Terms of Service and Community Standards, including on your land and in what your venue plays.
Linden dollars (L$) are Linden Lab’s virtual currency and are governed by Linden Lab’s terms. Every price, refund and limit in these terms is stated in L$. We make no claim about what L$ are worth outside Second Life.
4. What the service includes #
Each paid venue gets:
- its own radio station on our server. Stations run on AzuraCast, open-source broadcasting software that we use without modification;
- a streaming login for each DJ the owner adds;
- AutoDJ, which plays music the owner uploads (up to 50 MB per file) when no DJ is live;
- a lineup (schedule) in Second Life Time;
- optional Discord alerts, if the owner adds a Discord webhook;
- club managers, and a history of payments and tips;
- owner and DJ dashboards, opened with one-time links from in-world. There are no passwords.
The in-world board, tip jar and other CueSwitch devices are not part of the club price. They are sold separately at the CueSwitch shop. A new club does not get a venue kit with its payment. An owner who already has a venue kit keeps it, and keeps Resend kit and updates.
Stream quality, listener and storage limits are listed on the pricing page. We may improve, change or add features over time.
5. DJ Live and DJ Radio #
DJ Live and DJ Radio are personal streams for one DJ or singer, sold at the Performer Terminal in the CueSwitch store. They are not a club venue. They are described on the DJ streams page.
- DJ Live: a Shoutcast/Icecast-compatible stream at 320 kbps for up to 100 listeners, with one streamer login (the buyer’s), and a web account at CueSwitch. It is live only: you cannot upload music, and a placeholder plays when you are off air.
- DJ Radio: DJ Live, plus uploads and AutoDJ, which plays when nobody is live, and up to 5 GB of music.
The buyer is the owner of the stream and its only streamer. A DJ plan has no DJ list and no separate DJ logins. A DJ plan does not include the DJ Tip Jar or a performer kit, and a new DJ Live or DJ Radio payment does not deliver one. An owner who already has a performer kit keeps it, and keeps Resend kit and updates.
6. Prices and payment #
A club venue costs L$400 for 1 week, L$1,600 for 4 weeks or L$4,800 for 12 weeks. You pay at a CueSwitch Terminal in Second Life. The terminal only accepts these amounts. Any other amount is refunded automatically. A new club's first week costs L$125 at the CueSwitch HQ Terminal. It is one time, for an avatar that never had a CueSwitch club venue, and only for the first 5 clubs. A DJ Live or DJ Radio stream does not count as a club venue. Any other L$125 payment is refunded automatically.
DJ Live costs L$75 for 1 week, L$300 for 4 weeks or L$900 for 12 weeks. DJ Radio costs L$150 for 1 week, L$600 for 4 weeks or L$1,800 for 12 weeks. These are the same price for every week, with no multi-week discount. You pay them at the Performer Terminal in the CueSwitch store, not at the club terminal or the Home Terminal. The L$125 first week is for new clubs only, never for a DJ plan.
- Prepaid. Your first payment creates your venue. Later payments add weeks to it. If your venue is running or in grace, the new weeks start where your paid time ends. If it is paused, they start when you pay.
- Changing plan. You can move from DJ Live to DJ Radio at any time by paying a DJ Radio price. The paid time you have left on DJ Live is converted by its L$ value, so it becomes half as many days of DJ Radio, and the DJ Radio weeks you buy are added to it. Paid time can also be moved to a club venue by its L$ value, from the owner dashboard (Move paid time). A DJ Live payment made for a DJ Radio stream is refused and refunded at once, with the DJ Radio prices (L$150 for 1 week, L$600 for 4 weeks or L$1,800 for 12 weeks).
- Autopay is optional and off by default. Unless you switch it on, nothing renews by itself and we never charge you unless you pay at a terminal. Autopay is a setting on your CueSwitch Home Terminal, for clubs. You choose how many weeks it may pay, from 1 to 8. Each time your paid time runs out, the Home Terminal pays for one more week (L$400) from your L$ balance, using the debit permission you gave it. It never pays more than one week’s price for a week. After the weeks you chose, it stops by itself. You get a receipt by IM for every charge. You can turn it off at any time on the Home Terminal (Options > AutoPay) or on your dashboard. It can only charge while the Home Terminal is rezzed and still has your debit permission. If a charge can’t be made, nothing is taken, an IM tells you why, and the normal reminders and grace apply. If you stop paying, your venue lapses as described in When paid time runs out.
- Reminders. We send reminders 3 days and 1 day before your paid time ends. They arrive by IM from Cara Rewell, the CueSwitch automated assistant, and also from your CueSwitch board if you have one rezzed. Reminders are a courtesy: a missed reminder does not extend your time.
- Price changes. We may change prices. A new price applies only to payments made after it takes effect, and we announce it on the pricing page at least 14 days before. Time you have already paid for is never re-priced.
Refunds are covered by the Refund Policy.
7. When paid time runs out #
- Grace (3 days). Your stream keeps running and the board shows a renewal warning.
- Paused. If you haven’t paid by the end of grace, your station is switched off and the stream stops. Your settings, DJs, lineup and music are kept. Pay at a terminal and the venue comes back with its setup. The new weeks start when you pay.
- Deleted (30 days after the pause; 7 days for DJ Live and DJ Radio). If you still haven’t paid, we delete the venue’s station and uploaded music, its DJs and their logins, its lineup, its alert subscribers, its login links and its Discord webhook, and we remove tippers’ names and avatar keys from its tip records. Payment and tip records we keep for accounting are described in the Privacy Policy.
For a DJ Live or DJ Radio stream the grace and the pause are the same, but its data is kept 7 days after the pause, not 30. Then the station and its uploaded music are deleted.
Deleted data cannot be recovered. A payment after deletion starts a new venue or stream from scratch. Keep your own copies of the music you upload.
8. Your part: owners and DJs #
Venue owners
- Keep your one-time links private. Anyone who has an unused link can open your dashboard with it. Setup links last 24 hours and login links 15 minutes, and each one works once.
- You choose your DJs and you are responsible for what is played at your venue, live or on AutoDJ.
- You are responsible for your land, your club rules and your arrangements with your DJs, including how tips are split and any pay.
DJ Live and DJ Radio buyers
- You are the owner of your stream and its only streamer. Your streaming login is for you alone. Don’t share it.
- You are responsible for what you stream and upload (see Music and content rights).
- Your stream takes up to 100 listeners at once.
DJs
- Your streaming login is for you alone. Don’t share it.
- Stream only what you have the rights to (see Music and content rights).
- The venue owner controls your access. They can add or remove you, and can limit your logins to your scheduled sets.
9. Music and content rights #
Venue owners and DJs are solely responsible for having every right and licence needed for everything they upload to CueSwitch or stream through it, including any licence needed to broadcast it to the public.
CueSwitch is a hosting and technical service. We don’t choose, check or approve what is played, and we don’t provide or pay for music licences.
You keep whatever rights you have in what you upload. You give us permission to store, copy, convert and stream it, only to run your venue’s station and only while the venue exists.
Don’t upload or stream anything illegal, or anything that breaks the Second Life Terms of Service or Community Standards.
We may remove any file, cut a live stream or suspend a venue if we receive a valid notice about it, or if we believe it breaks these terms or the law. We tell the owner what we removed and why, unless the law or an urgent risk stops us.
10. Copyright notices and repeat infringers #
If you believe something on CueSwitch infringes your copyright, send a notice to [email protected] with:
- your name and how to contact you;
- the work you believe is infringed;
- where it is on CueSwitch: the venue name and the track name, or the date and time (SLT) it was streamed live;
- a statement that you believe in good faith that the use is not authorised by the rights holder or the law;
- a statement that your notice is accurate and that you are the rights holder or authorised to act for them, signed with your name.
We act on complete notices promptly, usually by removing the file or stopping the stream, and we tell the venue owner. If the owner believes the removal was a mistake, they can reply to us with their reasons, and we may restore the content unless the rights holder tells us they have started legal action.
Repeat infringers. When a venue or a DJ is the subject of 2 valid notices within 12 months, we close that venue or remove that DJ’s access. In serious cases we may act after one notice. A venue closed for infringement is not refunded.
11. Tips and the tip jar #
- The tip jar belongs to the venue owner. Tips paid into it go to the owner’s L$ balance.
- When a DJ is on deck, CueSwitch’s script pays the DJ their share of each tip from the owner’s balance, using the debit permission the owner grants to the jar. The share is the percentage the owner sets, rounded down to a whole L$. The venue keeps the rest.
- On AutoDJ, when the owner is on deck, or when the DJ can’t be identified, the venue keeps the whole tip. On a DJ Live or DJ Radio stream the owner is the only streamer, so the owner keeps all tips.
- CueSwitch never receives or holds tip money and takes no cut of tips.
- The debit permission lets the jar’s script pay L$ out of the owner’s balance. The script only uses it to pay DJ shares, never pays out more than the tip it received, and never pays the same tip twice. Granting it is the owner’s choice. Without it, tips stay with the owner.
- If the jar can’t reach CueSwitch, the tip stays with the owner and the DJ is not paid automatically. Settling that is up to the owner and the DJ.
Tips are voluntary gifts to the venue and the DJ. CueSwitch can’t refund tips and is not part of any disagreement between owners, DJs and tippers about them. The owner’s tip history can help settle one.
12. Alerts and messages #
Go-live alerts go by IM only to avatars who chose “Alerts on” at a venue’s board. “Alerts off” stops them. Alerts are never sent by bots, and CueSwitch sends no group notices.
Discord alerts are sent only if the owner adds a Discord webhook. They are automated messages from CueSwitch to the owner’s channel (a DJ going live, an upcoming set, half-time), labeled as automated, and they never ping anyone. Discord’s own terms apply there.
13. CueSwitch objects and scripts #
CueSwitch terminals, boards and tip jars, and the scripts in them, remain ours. We give owners copies to use with their own venue, while the venue exists. They are no-modify and no-transfer.
We may send newer versions through the CueSwitch Courier. Older versions may stop working, and we may disable an object that is misused.
14. Things you must not do #
- Use CueSwitch to break the law, the Second Life Terms of Service or the Community Standards.
- Upload or stream content you don’t have the rights to.
- Use song requests, alerts or any other feature to harass or spam people.
- Try to read, copy, change or reverse-engineer CueSwitch scripts, extract their keys, or send fake requests to our server.
- Attack, overload or probe the service, or try to get into another venue’s dashboard, station or data.
- Share, sell or resell access to CueSwitch, a dashboard or a streaming login.
15. Ending the service #
You can stop at any time by not paying again. You can also ask us to delete your venue early. Either way, paid time is not refunded except as set out in the Refund Policy.
We may pause or close a venue, or block an avatar from CueSwitch, without refund, if:
- you break these terms;
- we receive valid copyright notices about the venue (see Copyright notices);
- Linden Lab or the law requires it;
- it is needed to protect the service, other venues or other people.
We tell you why, unless the law stops us.
If we stop offering CueSwitch altogether, we give at least 30 days’ notice where we can, and refund the unused whole weeks of every venue in L$.
16. Availability and maintenance #
We run CueSwitch on a best-effort basis. We don’t promise any level of uptime, and we don’t promise that the stream, the board, alerts or the dashboards will always work or be free of errors.
The service needs maintenance from time to time. We try to do planned work outside busy club hours and to tell owners in advance when we can.
CueSwitch depends on things we don’t control, including Second Life itself (regions, scripts, HTTP requests, media and L$ transfers), our hosting provider, and each DJ’s own internet connection and software.
Downtime does not extend your paid time automatically. After a long outage on our side we may add time to affected venues, at our discretion. We don’t promise backups of your uploads, so keep your own copies.
17. Disclaimers and limits on our liability #
As far as the law allows, CueSwitch is provided “as is” and “as available”, without warranties of any kind, including that it is fit for a particular purpose.
As far as the law allows, we are not liable for:
- lost tips, lost audience, lost L$ income or lost events;
- lost or deleted data, including uploaded music;
- problems caused by Second Life, Linden Lab, Discord, your DJs or other third parties;
- any indirect or consequential loss.
Our total liability to you for anything to do with CueSwitch is limited to the L$ you paid us for the service in the 12 weeks before the event that led to the claim.
If someone makes a claim against us because of content you uploaded or streamed, or because you broke these terms, you agree to cover our reasonable costs of dealing with it.
Nothing in these terms limits liability that the law does not allow to be limited, or rights you have that cannot be waived.
18. Changes to these terms #
We may update these terms. We post the new version on this page with a new effective date, and give at least 14 days’ notice of material changes before they take effect. If you keep using CueSwitch or pay again after that, the new terms apply. Changes never re-price time you have already paid for.
19. Governing law and disputes #
These terms are governed by the law of the State of Israel, and disputes go to its courts.
If something goes wrong, contact us first at [email protected]. Most problems can be fixed quickly. Mandatory consumer protections where you live still apply.
